Access Bank, Ubah, Others Know Fate Today In Contempt Suit

A Federal High Court in Lagos will today deliver ruling on a fundamental rights enforcement suit filed by the Managing Director of Capital Oil and Gas Limited, Ifeanyi Ubah, against the Nigeria Police and others.

Ubah had filed the suit before Justice Chukwujekwu Aneke, claiming N10 billion damages over his detention for 10 days in connection with alleged N43 billion oil subsidy fraud.

Apart from the Inspector General of Police (IGP), Muhammed Abubakar, other persons listed as defendants in the matter are the Commissioner of Police in charge of Special Fraud Unit (SFU),  Ayotunde Ogunsakin; Managing Director of Access Bank, Aigboje Aig-Imokhuede, and Chief Executive Officer of Coscharis Motors, Cosmas Maduka.

However, thw SFU in a preliminary objection filed by its lawyer, Godwin Obla, faulted the suit and described it as an abuse of court process.

He argued in the objection that the police could not be restrained from carrying out its statutory duties as “Ubah sought to do with the case.”

 Obla furher argued that the subject matter of the suit had been litigated upon by another court, apart from the fact that the company (Capital Oil) has not satisfied the condition precedent to enjoy the rights prescribed under the human rights enforcement proceedings.
